CHANGING, ADOPTING ASSOCIATION RULES AND REGULATIONS

WHEN RULES OF THE ASSOCIATION NEED TO BE UPDATED, AMENDED OR ADOPTED, THIS IS HOW TO DO IT!

California Civil Code Sections 4340 through 4370 addresses this subject.

In recent days I have received numerous calls from Homeowners and Boards of Directors concerning the function of the Board of Directors with regards to the enforcement of the Rules that the govern the association.

There is little doubt among homeowners that the Board of Directors has a duty to effectively administer to affairs of the association. It has become apparent that Homeowners are becoming increasingly knowledgeable, more informed and more involved in the affairs of the Association.

In many situations the Rules and Regulations governing the Association are not suitable to help resolve the matters affecting the Association. New Rules may be needed. Some Rules may be outdated others may have become ineffective.

The following process may help in changing, or adopting the operating Rules of the Association
